Subway® SMS Terms & Conditions

These SMS Terms & Conditions (“SMS Terms”) govern your participation in the Subway® SMS Alerts program (the “Program”), operated by Franchise World Headquarters, LLC (together with its affiliates “Subway,” “we,” “us,” or “our”). These SMS Terms supplement our Terms of Use and Privacy Policy. By opting in to the Program, you agree to these SMS Terms.

1. Program Description and Consent

The Program provides recurring promotional and marketing SMS and MMS messages from Subway, which may include offers, deals, rewards, product updates, menu news, and other promotional information.

By opting in to the Program through a method provided by Subway, you expressly consent to receive recurring SMS and MMS promotional and marketing text messages, including messages sent using an automated system, automated device, or other automated technology, from Subway at the mobile telephone number you provide. Your consent to receive marketing text messages is not a condition of any purchase.

You represent that you are the subscriber or customary user of the mobile telephone number you provide or are otherwise authorized to enroll that number in the Program.

2. Message Frequency and Charges

Message frequency varies. Message and data rates may apply depending on your mobile service plan. MMS messages may incur additional charges depending on your wireless carrier and mobile service plan. Subway does not charge a separate fee for participating in the Program.

3. Opting Out

You may opt out of the Program at any time by replying STOP to a Program message. After you submit an opt-out request, you may receive a one-time SMS or MMS text message confirming your unsubscribe request. After your opt-out request has been processed, you will no longer receive promotional or marketing SMS or MMS text messages through the Program unless you subsequently opt in again.

Your withdrawal of consent to receive marketing text messages does not affect other communications you may receive from Subway® that are not part of this Program, including transactional or account-related communications where permitted by applicable law.

4. Help and Customer Support

For help with the Program, reply HELP to a Program message or contact Subway Guest Care at: Guest Care (United States).

5. Supported Carriers and Message Delivery

The Program may not be available on all mobile devices or through all wireless carriers. Wireless carriers are not responsible for delayed or undelivered messages. Delivery of SMS and MMS text messages is subject to effective transmission by your wireless carrier and is outside Subway’s control.

The telephone number or short code used to send Program messages may change from time to time.

6. Mobile Number Changes

If you change, deactivate, or relinquish the mobile telephone number enrolled in the Program, you should opt out of the Program before doing so. You agree not to provide a mobile telephone number that you do not own or are not authorized to use.

7. Privacy

Information collected and used in connection with the Program will be handled in accordance with Subway’s Privacy Statement.

8. Changes to or Termination of the Program

Subway may modify, suspend, or discontinue the Program, or modify these SMS Terms, from time to time. Any material changes to these SMS Terms will be made available through the Program website or otherwise communicated as required by applicable law.

9. Relationship to Other Subway® Messaging Programs

These SMS Terms apply to the Subway SMS Alerts marketing Program operated by Franchise World Headquarters, LLC. They do not govern separate text messaging programs operated independently by Subway franchisees or other third parties, which may be subject to separate terms and conditions.

These SMS Terms also do not govern transactional text messages that may be sent in connection with orders or other Subway services where those messages are subject to separate terms or disclosures.

10. General Terms

These SMS Terms supplement the Subway Terms of Use. Except as expressly provided in these SMS Terms, the Terms of Use apply to your participation in the Program, including the applicable provisions concerning governing law and dispute resolution.

In the event of a conflict between these SMS Terms and the Terms of Use with respect to the Program, these SMS Terms will control.
